1. Accepting these terms
By accessing or using FitMode, you agree to these Terms of Service and the Privacy Policy. If you do not agree, do not use the service.
2. Eligibility and accounts
- You must be at least 13 and legally able to agree to these terms. Additional age requirements may apply where you live.
- You must provide accurate account information and keep your login credentials secure.
- You are responsible for activity performed through your account and should notify the operator if you suspect unauthorized access.
3. The FitMode service
FitMode provides general fitness planning, workout organization, progress tracking, estimated metrics, and links or embeds for third-party fitness content. Features may change, be suspended, or be discontinued.
FitMode does not guarantee that a particular program, estimate, recommendation, trainer, video, or feature will always be available.
4. Health and safety
Exercise involves risk. You are responsible for deciding whether an activity is appropriate for you, using safe technique and equipment, and stopping if you experience pain, dizziness, shortness of breath, or other concerning symptoms.
FitMode does not provide medical diagnosis or treatment. Review the Health and Fitness Disclaimer before using workout or nutrition-related features.
5. Acceptable use
- Do not use FitMode for unlawful, fraudulent, abusive, or harmful activity.
- Do not attempt to bypass security, access another person's account, disrupt the service, scrape protected content, or introduce malicious code.
- Do not copy, redistribute, or commercially exploit FitMode content except where permission or applicable law allows it.
- Do not submit medical records, emergency information, or content that violates another person's rights.
6. Third-party content and services
FitMode may link to or embed videos, authentication tools, hosting, and other services provided by third parties. FitMode does not control those services and is not responsible for their availability, content, security, or practices.
Your use of third-party services may be governed by separate terms. Trainer names, videos, trademarks, and other third-party materials remain the property of their respective owners.
7. Intellectual property
FitMode and its original software, design, branding, and content are protected by intellectual-property laws. These terms give you a limited, personal, non-exclusive, non-transferable right to use the service for lawful personal purposes.
8. Suspension and termination
The operator may restrict or terminate access when reasonably necessary to protect users, the service, or third parties; investigate misuse; comply with law; or enforce these terms. Account-deletion and appeal procedures must be finalized before production launch.
9. No warranties
To the extent permitted by law, FitMode is provided on an "as is" and "as available" basis. The operator does not warrant uninterrupted service, error-free information, specific fitness results, or that estimates and recommendations will be accurate for every user.
10. Limitation of liability
To the extent permitted by law, the FitMode operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses arising from reliance on estimates, third-party content, account misuse, service interruption, or exercise participation.
Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply. Consumer rights that cannot legally be waived remain unaffected.
11. Changes, governing law, and contact
FitMode may update these terms as the service changes. Material changes should be communicated appropriately, and continued use after the effective date means you accept the updated terms where permitted by law.
